The Horror Section Studios Merchandise Store (the "Store," "we," "us," or "our") respects your privacy. The Store is operated by Off Court Creations, LLC, a Delaware limited liability company with its principal address at 254 Chapman Rd STE 208, Newark, DE 19702 ("Off Court Creations"), in partnership with The Horror Section Inc., a Delaware corporation ("The Horror Section"). Off Court Creations processes personal information collected through the Site for purposes including order processing, payment, customer service, marketing, and sales tax compliance.

This Privacy Policy explains what information we collect, how we use it, and the choices you have when you visit our website, make a purchase, or otherwise interact with us (collectively, the "Site").

By using the Site or placing an order, you agree to the practices described in this Policy.

We collect information in three ways: information you provide directly, information collected automatically, and information from third parties.

Information you provide directly:

  • Name, shipping and billing addresses

  • Email address and phone number

  • Payment information (processed by our payment provider — see Section 4)

  • Account credentials, if you create an account

  • Communications you send us, including support requests and reviews

  • Marketing preferences and survey responses

  • Any content you voluntarily submit (photos, reviews, social tags)

Information collected automatically:

If a data breach affecting your personal information occurs, we will notify you as required by applicable law, including Indiana's Disclosure of Security Breach statute (Ind. Code § 24-4.9).

8. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, including order fulfillment, accounting, dispute resolution, and legal compliance. Order records are typically retained for at least the period required by tax and consumer-protection laws. When information is no longer needed, we delete or anonymize it.

9. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information.

California residents (CCPA/CPRA): You have the right to know what personal information we collect, use, disclose, or share; to request deletion or correction; to opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising; and to limit the use of sensitive personal information. We will not discriminate against you for exercising these rights.

EEA, UK, and similar jurisdictions (GDPR/UK GDPR): You have the right to access, correct, delete, restrict processing, object to processing, and request portability of your personal data, and to withdraw consent at any time.

Other U.S. states (Virginia, Colorado, Connecticut, Utah, etc.): You may have similar rights to access, correct, delete, and opt out of targeted advertising and the sale of personal data.

To exercise any of these rights, email info@offcourtcreations.com with the subject line "Privacy Request." We will verify your identity before responding. You may also designate an authorized agent to make a request on your behalf, subject to verification.

10. Marketing Communications

We send marketing communications by email and SMS text message about new releases, drops, pre-orders, promotions, and events. These communications may be sent by Off Court Creations, by The Horror Section, or by both jointly.

Email. Marketing emails are sent in compliance with the CAN-SPAM Act. You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing message or by contacting us at info@offcourtcreations.com.

SMS. If you opt in to SMS marketing (for example, by providing your phone number at checkout, in a sign-up form, or by texting a keyword), you consent to receive recurring automated marketing text messages at the number provided. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message, or get help by replying HELP. SMS programs operate in compliance with the Telephone Consumer Protection Act (TCPA) and applicable carrier requirements.

We will continue to send transactional messages related to your orders and account regardless of marketing preferences.

11. Do Not Track

Some browsers transmit "Do Not Track" signals. Because no consistent industry standard exists, our Site does not currently respond to these signals. We do honor recognized opt-out preference signals (such as Global Privacy Control) where required by law.

12. Children's Privacy

The Site is not directed to children under 13 (or under 16 in jurisdictions where that is the applicable threshold), and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, contact info@offcourtcreations.com and we will delete it.

Some products and content on the Site contain mature horror themes intended for adult audiences. Customers must be at least 18 (or the legal age of majority in their jurisdiction) to make a purchase.

13. International Data Transfers

We are based in the United States. If you access the Site from outside the U.S., your information will be transferred to, stored, and processed in the U.S. or other countries where we or our service providers operate. By using the Site, you consent to such transfers. Where required by law, we use appropriate safeguards (such as Standard Contractual Clauses) for cross-border transfers.

The Site may contain links to third-party websites and services. We are not responsible for the privacy practices of those third parties. Review their privacy policies before sharing personal information with them.
