Welcome to The Horror Section Studios Merchandise Store (the "Store"), operated by Off Court Creations, LLC, a Delaware limited liability company ("Off Court Creations"), in partnership with The Horror Section Inc., a Delaware corporation ("The Horror Section"). Off Court Creations operates the Site, including order processing, payments, and customer service. Marketing communications may be sent by Off Court Creations, by The Horror Section, or by both jointly. These Terms of Service ("Terms") govern your access to and use of the Store website and any content, products, or services offered through it (collectively, the "Site"). In these Terms, "we," "us," and "our" refer to The Horror Section Studios Merchandise Store. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction (whichever is greater), to purchase from the Site. Some products and content on the Site contain mature horror themes, including imagery related to violence, gore, the occult, and other content unsuitable for minors. By using the Site, you represent that you are of legal age and that any such content is lawful to view and possess in your jurisdiction.

2. Account Registration

If you create an account, you are responsible for:

  • Providing accurate, current, and complete information

  • Maintaining the confidentiality of your login credentials

  • All activity that occurs under your account

  • Promptly notifying us of any unauthorized access

We may suspend or terminate accounts at our sole discretion, including for fraud, chargebacks, abuse, or violation of these Terms.

3. Orders and Pricing

All orders are offers to purchase, subject to our acceptance. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear fraudulent, are placed by resellers without authorization, or contain pricing or descriptive errors.

Prices are listed in the currency stated at checkout and are subject to change without notice. Taxes, duties, and shipping fees are calculated separately and are the responsibility of the customer unless otherwise stated. Sales tax is calculated at checkout based on the shipping destination and applicable tax rules.

4. Shipping

Shipping timeframes are estimates only and are not guaranteed. Title and risk of loss pass to you upon our delivery of the product to the carrier. Customs duties, import taxes, and brokerage fees on international orders are the sole responsibility of the customer.

5. Returns, Refunds, and Cancellations

6. Intellectual Property

All content on the Site is owned by The Horror Section Inc., Off Court Creations, or their respective licensors, and is protected by copyright, trademark, trade dress, and other intellectual property laws.

Horror Section IP. The Horror Section Inc. owns all trademarks, logos, character likenesses, character names, film titles, film stills, story elements, artwork, and other intellectual property associated with The Horror Section brand and any related film, television, gaming, or media properties (collectively, the "Horror Section IP"). All Horror Section IP appearing on or in any product sold through the Site, and any derivative works incorporating the Horror Section IP, remain the exclusive property of The Horror Section Inc.

Platform IP. Off Court Creations owns the e-commerce platform and any content created independently of the Horror Section IP.

Your License. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not:

  • Reproduce, distribute, modify, or create derivative works of any content

  • Use any content for commercial purposes, including resale, merchandise, fan products, or AI training datasets

  • Remove any copyright, trademark, or proprietary notices

  • Scrape, mirror, or systematically download content from the Site

  • Use the Horror Section IP, the Off Court Creations name, or any trademarks, names, or branding of either party without prior written permission

No Transfer of IP With Purchase. Purchase of a physical product does not transfer any intellectual property rights to you. You acquire only the physical item. All artwork, characters, logos, film references, and other Horror Section IP appearing on the product remain the exclusive property of The Horror Section Inc., and any platform-owned designs remain the property of Off Court Creations. You may not reproduce, replicate, scan, or commercially exploit the design or imagery on any product you purchase.

7. Digital Products License

Digital products are licensed, not sold. Unless an explicit commercial license is included with the product, you receive a personal, non-exclusive, non-transferable, revocable license to use the digital product for private, non-commercial use only. You may not redistribute, resell, sublicense, share, or upload digital products to any platform.

8. User-Submitted Content

If you submit content to the Site (reviews, comments, social tags, photos, or other materials), you grant The Horror Section Inc. and Off Court Creations a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, and display that content in any media for marketing and operational purposes. You represent that you own or have all necessary rights to the content you submit and that it does not violate any third-party rights or applicable law.

We reserve the right to remove any user content at our sole discretion.

9. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law

  • Attempt to gain unauthorized access to any part of the Site, accounts, or systems

  • Interfere with or disrupt the Site, servers, or networks

  • Transmit malware, viruses, or any malicious code

  • Use bots, scrapers, or automated tools to access the Site without our written permission

  • Engage in fraudulent transactions, payment manipulation, or chargeback abuse

  • Harass, threaten, or impersonate any person, including our staff or other customers

  • Resell products in violation of any quantity limits or reseller restrictions

Violation may result in account termination, order cancellation, banning, and legal action.

10. Mature Content Disclaimer

The Site features horror-themed content that may include depictions of violence, gore, death, the macabre, occult symbolism, and other disturbing imagery. This content is intended for adult audiences as fiction and artistic expression. We do not endorse, promote, or encourage real-world violence, harm, or illegal activity. Viewer and customer discretion is advised.

11. Third-Party Links and Services

The Site may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and policies.

12. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCT COLORS, FINISHES, OR DETAILS WILL EXACTLY MATCH ON-SCREEN REPRESENTATIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HORROR SECTION INC., OFF COURT CREATIONS, AND THEIR RESPECTIVE OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PRODUCTS.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Horror Section Inc., Off Court Creations, and their respective affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

16. Modifications to the Site and Terms

We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms at any time, with changes effective immediately upon posting. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Indiana, and you consent to the personal jurisdiction of those courts.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Return and Refund Policy and Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
